Unified Family Courts: An Assessment of Different
Jurisdictional Models |
| Authors: |
James W. Bozzomo &
Gregory Scolieri |
| Publication: |
Family Court Review
(January 2004) |
| Abstract: |
| The
American Bar Association Coordinating Council on Unified
Family Courts, with the assistance of Hofstra University’s
Center for Children, Family and the Courts, conducted a
survey of various courts and jurisdictions that either
implemented or experimented with a unified family court
structure. The purpose of the project was to get a sense
of the state of unified family courts with the goal of
building more support for the unified family court
concept based on demonstrated effectiveness. The
findings of the survey are summarized in the article.
The survey, survey data, and list of survey respondents
can be found in the article’s appendices. |

A Call for Clarification: Achieving a Uniform Proof Structure in Reasonable Accommodation Cases Under the Americans With Disabilities Act |
| Authors: |
Gregory Scolieri & Matthew H. Woodard |
| Publication: |
Hofstra Labor and Employment Law Journal (2002) |
| Abstract: |
| This work analyzes the
issue of allocating and quantifying burdens of proof in reasonable
accommodation cases under the ADA. The approaches articulated by the
courts, as well as the EEOC, are questioned based upon the theory
that parties litigating such cases should bear burdens of proof that
are uniform in the manner in which they are allocated and in the
quantum of proof required to satisfy the burden imposed. Part II
identifies and explains the ambiguous provisions of the ADA. Part
III illustrates the various judicial interpretations of the ADA's
ambiguous language and argues for an equitable interpretation of the
ADA. Part IV considers the EEOC's interpretations of the ADA and the
lack of judicial deference to the agency's views on this matter.
Part V proposes a means of resolving the issue by analogizing it to
Title VII's modification by the Civil Rights Act of 1991. Cite
